class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A defici\u00eancia do filho mais novo e as dificuldades decorrentes dela levaram a dona de casa <strong>Lurdes Vanilda Chemello Faviero<\/strong> a propor uma emenda a ent\u00e3o convocada Assembleia Nacional Constituinte de 1988, o inciso V do artigo 203, fruto das 47.477 assinaturas colhidas.<\/p><p>O objetivo era a garantia de um sal\u00e1rio m\u00ednimo de benef\u00edcio mensal \u00e0 pessoa portadora de defici\u00eancia e ao idoso que comprovem n\u00e3o possuir meios de prover a pr\u00f3pria manuten\u00e7\u00e3o ou t\u00ea-la provida por sua fam\u00edlia, sendo hoje usufru\u00eddo por mais de 3 milh\u00f5es de pessoas.<\/p><p>Iniciada em fevereiro de 1987, o Deputado Ulysses Guimar\u00e3es foi respons\u00e1vel por presidir a jun\u00e7\u00e3o das duas casas do legislativo nacional brasileiro para a promulga\u00e7\u00e3o da s\u00e9tima carta magna do Brasil, que incluiria o dispositivo proposto por Vanilda Faviero.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section Nacional de Promo\u00e7\u00e3o dos Direitos da Pessoa com defici\u00eancia, hoje h\u00e1 mais de 2 milh\u00f5es de pessoas hipossuficientes e 1 milh\u00e3o e setecentos mil idosos. O benef\u00edcio de presta\u00e7\u00e3o continuada \u00e9 a garantia de um sal\u00e1rio m\u00ednimo mensal \u00e0 pessoa portadora de defici\u00eancia e ao idoso que comprovem n\u00e3o possuir meios de prover a pr\u00f3pria manuten\u00e7\u00e3o e nem de t\u00ea-la provida por sua fam\u00edlia.<\/p><p>A lei define a fam\u00edlia como incapaz de prover a manuten\u00e7\u00e3o da pessoa portadora de defici\u00eancia ou idosa aquela cuja renda mensal per capita seja inferior a 1\/4 (um quarto) do sal\u00e1rio m\u00ednimo. Pela Lei 8.742\/93 com o artigo 1\u00ba da Lei 9.720\/98, considera-se idoso quem tiver idade m\u00ednima de 65 anos e deficientes, com parecer do Servi\u00e7o Social e da Per\u00edcia M\u00e9dica, aqueles que t\u00eam impedimentos de longo prazo de natureza f\u00edsica, mental, intelectual ou sensorial que podem obstruir sua participa\u00e7\u00e3o plena e efetiva na sociedade em igualdade de condi\u00e7\u00f5es com as demais pessoas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column
